Going Out of Business or Fire Sale Permits

Do I need a permit for a going-out-of-business or fire sale?

Yes. Florida law requires a permit for going-out-of-business or fire sales. The Tax Collector’s Office issues permits for going-out-of-business or fire sales for a fee of $50.00, when certain criteria are met. The permit is good for 60 days.

What is a going-out-of-business sale?

A sale advertised in a way that reasonably causes the public to believe the business will close permanently once everything is sold.

Exception: A permit is not required if the business is closing due to a bankruptcy judgment.

What is a fire sale?

A sale advertised in a way that reasonably causes the public to believe goods were damaged by fire, smoke, water, or other disaster.
